The Sustainable Harnessing and Advancement of Nuclear Energy for Transforming India (SHANTI) Bill 2025 (2025年インド変革のための原子力の持続可能な活用と発展法)を12月18日に可決し、20日に立法手続きが完了した。
The Sustainable Use and Development of Nuclear Energy for Transforming India Act, 2025, was passed on December 18th, with the legislative process completed on the 20th.
The SHANTI Act repeal the Atomic Energy Act of 1962 and the Civil Liability for Nuclear Damage Act of 2010, amending the civil liability system for nuclear damage and allowing private companies to enter the nuclear power plant construction business.
The 2010 Civil Liability for Nuclear Damage Act contains provisions that allow liability for compensation in the event of a nuclear accident to be pursued not only from the operator but also from the nuclear power plant supplier (nuclear power plant manufacturer), and has been the largest barrier to nuclear power plant exports to India from countries such as France, the United States, and Japan.

[1] This ridiculous, self-justifying inversion of the term "SHANTI" is not only deceptive and misleading, but also deeply insulting to the sentiments of the Indian people, who cherish the Sanskrit word "Shanti" as meaning "supreme peace."
This Orwellian, cosmetic name is even blasphemous to the Hindus of this country, who chant "Shanti, Shanti, Shanti" at the end of the Bhagavad Gita verse with deep spiritual meaning.
[2] The SHANTI Bill, which aims to repeal the concise, clear, and purposeful laws of the Atomic Energy Act of 1962 and the Civil Liability for Nuclear Damage Act of 2010, encourage private companies to build and develop nuclear power plants, and attract foreign direct investment in the nuclear industry, significantly confuses the legal system and is a grave betrayal of the Indian people.
[3] While the SHANTI Bill appears to have a comprehensive and far-reaching regulatory framework, in reality it merely reproduces the same old "Ministry of Atomic Energy desk-and-chair" regulatory ritual.
While it presents the Nuclear Regulatory Commission as a comprehensive oversight body, the entire regulation process is internal, with little room for involvement from civil society, let alone the political community. Far from clearing the fog, this "regulatory" regime only deepens the opacity.
[4] Chapter 3, Article 11, Paragraph 1 of the SHANTI Bill provides that "the operator of a nuclear installation shall be liable for damage caused by a nuclear accident." While seemingly covering many aspects, including transportation and inter-operator relations, it also imposes a cap on operator liability.
Similar to the 2010 Liability Act, the Bill provides that "the maximum liability for each nuclear accident shall be the equivalent of 300 million Special Drawing Rights (SDRs) or such greater amount as the Central Government may determine by notification." It is puzzling that the liability cap has remained unchanged after 15 years. SDRs are an international reserve asset created by the International Monetary Fund (IMF).
This amounts to just $460 million (approximately ¥70 billion) per accident. The imposition of such a paltry cap, regardless of the scale of the disaster, is completely unacceptable and outrageous. It even falls short of the $470 million compensation paid to victims of the 1984 Bhopal chemical plant toxic gas leak (a gross underestimate). Given the potential for a major nuclear disaster far exceeding the Bhopal accident, this liability cap is tantamount to an insult to the nation's citizens.
If the compensation amount exceeds SDR 300 million (approximately ¥70 billion), the central government may access international funds under the IAEA-led Convention on Supplementary Compensation for Nuclear Damage (CSC). However, under no circumstances will the supplier (nuclear power plant manufacturer) be held liable. This bill places all compensation liability on the operator, completely exonerating the supplier.
Operators can only exercise their right of recourse against suppliers if it is expressly provided for in a written contract or if the damage is intentional. In practice, the possibility of supplier liability is virtually nil.
This blatantly promotes corporate interests at the expense of the public, violating the "Right to Life" guaranteed by Article 21 of the Indian Constitution.
[5] The establishment of new bodies such as the Nuclear Relief Advisory Council and the Nuclear Claims Commission will further strengthen the dominance of the nuclear bureaucracy and culture in the country.
The Ministry of Atomic Energy has already become a "sanctuary," where even verbal opposition can be treated as treason. No political party or political leader can criticize nuclear policy for fear of being branded a traitor.
The bill sets ambitious goals of decarbonizing the country by 2070 and achieving 100 GW of nuclear power by 2047. The result will be widespread nuclearization across the nation, from uranium mines and thorium mining, to nuclear power plants, small modular reactors (SMRs), deep geological repositories, and even nuclear weapons. Conflicts, violations, crimes, claims, and counterclaims will also increase.
We will become a nuclearized society dominated by the military-industrial complex, with the Atomic Energy Commission at its apex.
The consequences will be profoundly detrimental to the democratic foundations of the Republic, the safety and security of its people, and true Shanti. (Excerpt)

Udayakumar (National Coalition Against Nuclear Movement) Currently, the Nuclear Power Corporation of India Limited (NPCIL) operates 24 nuclear power plants at seven locations across the country, with a total installed capacity of 8.78 MW. NPCIL is currently constructing seven nuclear power plants (totaling 6.1 MW): Rajasthan Nuclear Power Plant Unit 8 (700 MW), Kudankulam Nuclear Power Plant Units 3, 4, 5, and 6 (Russian-built, 1 MW each), and Gorakhpur Nuclear Power Plant Units 1 and 2 (700 MW each). The Indian government has granted administrative and financial approval for the construction of ten indigenously manufactured pressurized heavy water reactors (PHWRs, 700 MW) in the following locations: Kaigara, Karnataka; Mahi Banswara, Rajasthan; Gorakhpur in Fatehabad District, Haryana; and Chukka in Mandla District, Madhya Pradesh. Once all these projects are completed in stages, total installed capacity is expected to reach 21.98 MW by 2031-32. The government also aims to achieve a nuclear capacity of 100 MW by 2047.
Large, imported light-water reactors are planned to be built with international cooperation in Jaitapur, Maharashtra, and Kovarda, Andhra Pradesh. The villages of Kindrai, Seoni District, Madhya Pradesh; Cheemeni, Kasaragod District, Kerala; and Haripur, Purba Medinipur District, West Bengal, are also being considered as potential nuclear sites. Immediately after the SHANTI Act was enacted on December 20, Adani Group began discussions with the Uttar Pradesh government to build eight 200 MW small modular reactors (SMRs) in the state. The state-run Bhabha Atomic Research Centre will design and develop the SMRs, and NPCIL will operate them for the group. The entire project is expected to be completed in five to six years.
Other major Indian conglomerates, including the Tata Group, Reliance Industries, and JSW Group, are reportedly vying for a stake in the nuclear power sector. In this way, India is becoming nuclear-armed, with a proliferation of "nuclear" assets: uranium mines, thorium mines, refineries, tailings ponds, nuclear power plants, nuclear parks, SMRs, AFRs (Areas Free Range Facilities), DGRs (Deep Geological Repositories), atomic bombs, hydrogen bombs, and more. Simply put, "nuclear here, nuke there, nuke, nuke everywhere." The true meaning of SHANTI is now revealed: So Hell Arrives Now Throughout India.
